As a company dedicated to efficient, effective and proper processing of life settlements, The Lifeline Program® has invested extensive time and thought when it comes to developing procedures and requirements in that regard. Unfortunately, we have observed several recurring and common errors in the application process that regularly delay funding and make transacting more difficult than it need be. To try to reduce those occurrences and make the transacting process easier, we would like to make you aware of some of these errors in the hopes of helping you & your clients avoid them.

The Lifeline Program® is pleased to announce that Jennifer Laws will now serve as the lead liaison for our Platinum Account Services Department. In her new role, Jennifer will be responsible for managing life settlements involving policies having a face value of $3 million or more, to help ensure efficient and expeditious processing, because policies having such face values as presented to us often involve more complex ownership structures. Jennifer's role as the head of the department is an important step in making the concept of Platinum Service a permanent, effective and well-functioning fixture within The Lifeline Program.

Stranger originated life insurance (STOLI) is one of the most pressing and polarizing issues currently being discussed and debated throughout the life settlement industry. Several recent newsworthy events provide a glimpse into current thinking on STOLI and provide a strong indication of what the future holds for this controversial life insurance practice.
On February 5, 2008, the Kentucky State House of Representatives took an important and unprecedented step to ban stranger originated life insurance (STOLI) by unanimously passing HB 348. This legislation is designed to protect consumers by prohibiting the initiation of life insurance for wager purposes, without restricting a policy owner's right to utilize the market value of a properly initiated policy as he or she sees fit. HB 348 follows the recommendations of the National Conference of Insurance Legislators (NCOIL) by focusing on STOLI and the issue of insurable interest at inception rather than life settlements as a whole. This measure has been fully endorsed by LISA and if passed by the Kentucky senate may serve as an example for other states to follow.
At about the same time, though likely a coincidence, the US District Court for the Southern District of New York ruled that a New York woman could proceed with her case to recover from a third party the death benefits paid by an insurer under a life insurance policy insuring her father, as part of what is being viewed as a STOLI arrangement . In her petition, the woman argued that the underlying transfer of rights relating to the life insurance policy should be voided because it was against public policy and amounted to an impermissible "wager policy" by a stranger on her father's life.
These are just two examples of how STOLI is being challenged on many different fronts and point to a day where these policies may cease to exist. The Lifeline Program® has a very clear and longstanding stance on STOLI - we don't fund life settlements which involve life insurance policies which we determine are STOLI. In fact, we have regularly spoken out against STOLI and the derogatory effects STOLI has been having on the life settlement industry - and likely will continue to have on our industry if not sufficiently addressed. However, the story is still taking shape and time will tell how the life insurance and life settlement industries will be affected. |

In early 2007, after several years of working in the U.S. Department of Interior, Bureau of Land Management's Oregon/Washington State office in Portland, Oregon as an Equal Employment Opportunity Claims Specialist responsible for analyzing discrimination cases and claims, I relocated to Atlanta, Georgia. Prior to my move, I began to search for a new position in which I could utilize the unique and specialized skill set I developed during my time in that bureau. I was extremely pleased to discover The Lifeline Program® and joined the company almost one year ago. In my current role, I am principally responsible for processing maturity claims and records management of insured tracking files, but also assist in other policy servicing functions that require I work closely with our funding department, as well as other special projects. It is rewarding and enjoyable to work so closely with such talented and dedicated teammates and managers, and I love the challenges and experiences that arise from working in a dynamic and leading company like The Lifeline Program®. |
